Terms of sale

These terms of sale (the “Terms”) govern access to and use of the FeedSniffer service, offered at https://feedsniffer.com, whether on the free plan or the paid Pro subscription.

They apply to every customer, whatever their country of residence. Creating an account constitutes acceptance of the Terms for the free plan; confirming payment constitutes acceptance for the Pro subscription.

The applicable version is the one in force on the date of subscription or, for a renewal, the one notified to the customer as provided in the “Changes to the service, prices and Terms” section.

The service is sold and supplied by:

Payments are collected through the Whop platform, which acts solely as payment provider: the supplier of the service is ASHENGEN FZCO.

The service is reserved for adults with the legal capacity to enter into a contract.

Customers ensure that using the service is permitted in their country of residence and comply with the rules that apply there.

An account belongs to a single person.

FeedSniffer offers two plans:

• -Free: the web terminal, with a feed delayed by 15 minutes and no notifications;
• -Pro: the live feed, Telegram alerts (channel or private messages filtered to the chosen instruments), spoken announcements of critical alerts and session briefings, for €19 per month or €180 per year.

The features of each plan are those presented on the pricing page at the time of subscription. A feature announced as coming soon only becomes part of the offer once it is made available.

Using the service requires a recent web browser and an internet connection. Receiving alerts requires a Telegram account, whose use is governed by Telegram's terms.

Access to the service requires an account created with a Google account or with an email address and password.

Customers keep their credentials confidential and are responsible for any use of their account. They report any unauthorized use without delay to contact@feedsniffer.com.

The account, the subscription and the Telegram channel invitation links are personal: they may not be shared, lent or transferred.

Prices are stated in euros, all taxes included: €19 per month for the monthly plan, €180 per year for the annual plan.

Payment is made by card through Whop's secure form. Card details do not pass through ASHENGEN FZCO's servers. The charge appears on bank statements under the name Whop.

Taxes applicable in the customer's country are calculated and collected by Whop at the time of payment.

The Pro subscription is activated as soon as payment is confirmed.

A promotional code applies the discount and duration shown in the payment form before it is confirmed, for example a first month free on the monthly plan. It may be restricted to new customers and to one use per person. When the period it covers ends, the subscription renews at the current price unless cancelled beforehand.

An offer may also take the form of extra subscription days, for example one additional free month on the annual plan. These days are added to the subscription after payment and push back the next renewal date accordingly; they cannot be exchanged for a refund.

Finally, an offer may take the form of a free trial period on the monthly plan. Nothing is charged during the trial; the first charge takes place when it ends, at the current price, unless the subscription is cancelled before that date. The trial is granted only once per customer.

If a renewal payment fails, further attempts are made and Pro access is maintained during that period. If payment does not go through, the account returns to the free plan.

The Pro subscription is taken out for one month or one year from the date of payment. It renews automatically for the same period, at the price then in force, until cancelled.

Customers may cancel at any time, free of charge, from the Account page of the terminal or by writing to contact@feedsniffer.com. To avoid paying for the next period, cancellation must take place before the renewal date.

Cancellation takes effect at the end of the current period: Pro access is kept until that date, and the period already started is not refunded.

When the subscription ends, the account returns to the free plan: alerts and access to the Telegram channel are removed.

Except in the case provided below, amounts paid are non-refundable, including when the subscription is cancelled during a period or is not used.

If ASHENGEN FZCO ends a subscription for any reason other than a breach by the customer, it refunds each complete month remaining in the paid period, to the payment method used.

FeedSniffer evolves: features may be added, modified or removed, in particular to reflect changes in sources and in the markets covered.

Any change that substantially reduces the Pro subscription is announced to the customer, who may then cancel as provided in the “Term, renewal and cancellation” section.

Any price increase or change to the Terms is notified to the customer by email or in the terminal at least 30 days before the renewal concerned. It applies from that renewal; a customer who does not accept it may cancel before that date.

The content of the free plan may change at any time.

FeedSniffer is an information service. The alerts, summaries, rankings, levels, briefings and measurements it provides are neither investment advice, nor a recommendation to buy, sell or hold any financial instrument, nor an incentive to trade.

ASHENGEN FZCO provides no investment services: it manages no capital, and neither receives nor executes any orders.

An alert indicates that a piece of information deserves attention. The decision whether or not to trade rests with the customer alone, under their sole responsibility.

Trading involves a high risk of capital loss, amplified by leverage. The published measurements of what the market did after an alert describe the past and guarantee no future result.

The classification and translation of information rely in part on automated processing, including artificial intelligence, which may contain errors.

ASHENGEN FZCO uses reasonable means to keep the service available, but cannot guarantee uninterrupted or error-free operation.

The service relies on third-party information sources and providers: data providers, hosting, Telegram, Whop. Information may arrive late, be incomplete or be missing, and an alert may not reach the customer, in particular if a third party fails or because of the settings of their device.

The service may be temporarily interrupted for maintenance.

The subscription grants the customer a personal, non-exclusive and non-transferable right to use the service for the duration of the subscription.

The following are prohibited in particular:

• -redistributing the alerts, feed or briefings, in whole or in part, to third parties, including in groups, channels or on social networks;
• -reselling the service or making it available to third parties;
• -automated extraction of content;
• -circumventing a plan's limits or security measures;
• -any use contrary to applicable law.

The site, the terminal, the texts, the rankings and the FeedSniffer brand are the property of ASHENGEN FZCO. Content from third-party sources remains the property of its owners.

If the customer breaches the Terms, ASHENGEN FZCO may suspend or close their account after a formal notice that has remained without effect for 8 days.

In the event of a serious breach, in particular account sharing, redistribution of content, fraud or an abusive payment dispute, suspension or closure may be immediate, without refund.

If ASHENGEN FZCO stops providing the service, it informs customers at least 30 days in advance and refunds current subscriptions as provided in the “Refunds” section.

ASHENGEN FZCO undertakes to use reasonable efforts (obligation of means).

It cannot be held liable for:

• -losses incurred on the markets, or decisions made on the basis of the service;
• -indirect damage, including loss of profit or a missed opportunity;
• -delays, errors or interruptions attributable to a third-party source or provider;
• -use of the service contrary to the Terms.

In all cases, the liability of ASHENGEN FZCO is limited to the amounts paid by the customer in the twelve months preceding the event giving rise to it.

These limitations apply to the extent permitted by applicable law: they do not exclude any liability that cannot lawfully be excluded, and do not deprive a consumer of rights granted to them by mandatory law.

Neither party is liable for a failure caused by an event reasonably beyond its control, including a general outage of the internet or of a hosting provider, a cyberattack, a decision by an authority, war, a natural disaster or the interruption of a data source. The obligations concerned are suspended for the duration of the event.

The customer's personal data is processed by ASHENGEN FZCO to provide the service, manage the subscription and provide support, as described in the legal notice: https://feedsniffer.com/en/legal-notice

Any question or complaint should be sent to contact@feedsniffer.com. ASHENGEN FZCO responds as promptly as possible.

In the event of a dispute, the parties seek an amicable solution before taking any legal action.

These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai.

Any dispute relating to their formation, performance or interpretation falls under the exclusive jurisdiction of the courts of Dubai.

These provisions apply subject to the mandatory consumer protection rules of the customer's country of residence, where those rules apply to them.

These Terms are available in French and English. In the event of any discrepancy between the two versions, the French version prevails.

The records of ASHENGEN FZCO's and Whop's systems serve as proof of subscriptions, payments and cancellations.

If any clause of the Terms is held invalid, the other clauses remain in force. Failing to rely on a clause does not constitute a waiver of the right to rely on it later.
